Disassociation from 6SILO, Crittiks, and EarthyTabs

An overdue balance of Rs 4,272,623 (approx. AUD 19,490, per Small Business Commission case CS0046117) remains outstanding from Don Hettiaratchie / Earthy Global Pty Ltd since April 2026. Settlement offers and final notices have been ignored and direct communication has been blocked.

Exported WhatsApp chats spanning October 2025 to July 2026 independently corroborate authorship, scope and default:

• VORIS group: Created by Don Hett on 09/04/2025; Nirmal added 30/03/2026. Don personally reviewed VORIS logos and added Nirmal as a core member.
• Ramesh x Shamila: Created by Don on 02/12/2025. Don directed the 6SILO / nextgenunlock.shop build, approving banners and colour changes.
• Crittiks Dev discussions: Shows the full Crittiks build and the 07/07/2026 handover: “everything is handed over now crittiks earthytabs and joinvoris all complete and yours to run.”
• 08/07/2026 final-demand group: Nirmal stated: “https://6silo.com/ I have created fully https://app.crittiks.com I have created fully https://earthyplatform.com/ I have created fully there no any template everything my coustam code… I have waited 4 days didn't take any action after request 2 months late payment… next hour I start take action.”

OSINT reconnaissance on 25 July 2026 confirms that Don Hett / 6SILO is publicly erasing VertexElite’s role and misrepresenting the origin of the disputed technology:

• Auspreneur — 7 April 2025: Names Don Hett as “founder and chief executive of Crittiks” and Shenik Fernando as “co-founder and chief technology officer,” with no mention of VertexElite or Nirmal Liyon, despite contemporaneous WhatsApp evidence showing VertexElite was building the platform at that time.
• Current 6silo.com: Claims: “At Crittiks we built a comprehensive operating system for creative teams” and “2024 Venture Expansion — Crittiks, Earthy Tabs & beyond.”
• Wayback Machine — February 2025: The archived footer of crittiks.com identifies the operating entity as Crittiks Group Pty Ltd, trading as Crittiks Global Pty Ltd — not Earthy Global Pty Ltd or 6SILO Group — yet the current 6silo.com presents Crittiks as a 6SILO-built venture.
• Prospeo directory listing for 6SILO Group: Lists 1–10 employees and ~AUD $171k revenue, which contradicts 6silo.com’s claim that Don Hett built CleanKings from “zero to 650+ jobs.”

Despite non-payment, Don Hettiaratchie continues to operate public websites that contain my copyrighted code and assets:

• 6silo.com: Hosted on Vercel; still lists me as “Co-Founder & Head of Development” and VertexElite as the “Lead Technology Partner” — an association I now revoke.
• crittiks.com: Hosted on Vercel and contains at least 7 proprietary assets that are byte-for-byte identical to my original source files (592,437 bytes, SHA-256 matched).
• app.crittiks.com: Non-functional (SSL connection fails), proving there is no independently operational platform behind the public landing page.

Vercel DMCA case 01347892 was escalated on 25 July 2026 after Vercel’s own 17 July deadline expired without action.

If you are an investor, collaborator, or customer of 6SILO, Crittiks, or EarthyTabs, be aware that:

• The technology you are evaluating was built by a developer who has not been paid.
• The public sites are operating without a valid licence or assignment of intellectual property.
• Public claims that Don Hett or 6SILO “built” Crittiks / EarthyTabs are contradicted by contemporaneous WhatsApp evidence, archived snapshots and directory records.
• Any claim that these platforms are fully independent or operational is contradicted by live technical checks and by Don Hett's own WhatsApp messages directing the build.

The following clarifications follow forensic work completed on 26 September 2026, comparing my delivered source code against publicly served files only. The original notice above stands as published on 25 July 2026.

7.1 — Title never transferred; the use is unauthorised. Per the terms stated in INV-2026-0215-001, asserted in writing on 26 April 2026 (EXHIBIT-D): “All source code, assets, and documentation become exclusive property of EarthyTabs upon receipt of full payment.” Full payment was never received — Don Hettiaratchie’s own payment summary of 3 July 2026 records the outstanding EarthyTabs balance. Title to the intellectual property therefore never transferred. The 7 July 2026 handover delivered possession of the systems, not ownership of them, and their continued commercial operation since that date is unauthorised use of unpaid work.

7.2 — Engine match confirmed. The delivered “EarthyTabs DTAP” platform and the live platform share the same calculation engine under a changed interface:

• The delivered impact engine returns exactly twelve metrics; the live platform markets “12 verified metrics” and “all twelve metrics”.
• The bespoke field usageExtensionFactor from my delivered engine appears verbatim in the live platform’s public JavaScript.
• The live admin interface shows Refunds, Returns and Exchanges modules — the Phase 3 features I added on 4 April 2026.
• The handover database audit log records [email protected] being created as super_admin on 5 July 2026, two days before handover.

Verdict: the same calculation engine, with a presentation layer evolved after delivery. See EXHIBIT-BS — Platform Engine Match (sealed, with SHA-256 manifest).

7.3 — Ledger. Don Hettiaratchie’s own payment summary of 3 July 2026 records an EarthyTabs gap of Rs 1,051,000 (Rs 2,711,000 invoiced against Rs 1,660,000 paid). VertexElite’s invoice ledger for Crittiks records Rs 4,240,000 invoiced and Rs 2,676,623 outstanding. The Crittiks balance is additionally the subject of a creditors’ statutory demand (Form 509H, s459E Corporations Act 2001 (Cth)) for AUD $84,000 naming SILO GROUP PTY LTD ACN 154 054 172.
